Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using PressureIQ (the “Platform”), operated by Pivot Training & Development (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

These terms apply to all users, including individual users, team administrators, and Enterprise account holders.

2. Description of Service

PressureIQ is a Stress Intelligence Assessment platform that measures how individuals respond to pressure through a 20-question, scenario-based Situational Judgment Test (SJT). The assessment evaluates behavior across four pressure domains (Time Pressure, Interpersonal Conflict, Ambiguity, and High-Stakes Decisions) and produces one of six Pressure Modes.

PressureIQ is a professional development and self-awareness tool. It is not a diagnostic instrument, medical assessment, or clinical evaluation. Results should not be used as the sole basis for employment decisions, clinical diagnoses, or legal proceedings.

3. User Accounts

• You must provide accurate, current, and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must be at least 18 years old or the age of majority in your jurisdiction to use PressureIQ.
• We reserve the right to suspend or terminate accounts that violate these terms or are used fraudulently.

4. Intellectual Property

All content, assessment questions, scoring algorithms, archetype frameworks, methodologies, branding, and software code comprising PressureIQ are the exclusive intellectual property of Pivot Training & Development.

• You may not reproduce, distribute, modify, reverse-engineer, or create derivative works from any part of the Platform.
• Your personal assessment results belong to you. You may share your own results at your discretion.
• Enterprise white-label usage is governed by a separate Enterprise agreement.

5. Payment & Subscriptions

• Free-tier users may access limited features at no charge. Paid plans (Pro, Team, Enterprise) are billed on a monthly or annual basis as selected at purchase.
• Subscriptions renew automatically unless cancelled before the renewal date.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.
• Refund requests are handled on a case-by-case basis. Contact us at info@pivottrainingdev.com for billing inquiries.

6. Limitation of Liability

PressureIQ is provided “as is” without warranties of any kind, express or implied. Pivot Training & Development is not liable for:

• Decisions made based on assessment results, including hiring, promotion, or termination decisions.
• Indirect, incidental, special, or consequential damages arising from use of the Platform.
• Service interruptions, data loss, or security breaches beyond our reasonable control.

Our total liability shall not exceed the amount you paid for the Platform in the 12 months preceding the claim.

7. Governing Law & Dispute Resolution

These terms are governed by the laws of the State of Ohio, without regard to conflict of law principles. Any disputes arising from these terms or your use of PressureIQ shall be resolved through binding arbitration in Cuyahoga County, Ohio, unless otherwise agreed in writing.

If any provision of these terms is found unenforceable, the remaining provisions shall continue in full force and effect.
